1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

The Service is intended for users located in the United States. We make no representation that the Service is appropriate or available for use in other locations.

2. Educational Purpose — Not Financial Advice

Nothing on the Service constitutes:

• Financial advice
• Investment advice
• Trading advice
• Legal advice
• Tax advice
• A recommendation to buy, sell, or hold any security or other financial instrument
• A solicitation or offer to buy or sell any security

The analysis, signals, trade plans, confidence scores, and all other outputs generated by Bullseye AI are based on historical data, mathematical models, and algorithmic analysis. Past performance is not indicative of future results. All investing and trading involves substantial risk of loss. You may lose some or all of your invested capital.

Options trading involves additional risks including the risk of losing the entire premium paid. Options are not suitable for all investors.

You are solely responsible for your own investment and trading decisions. Before making any investment or trading decision you should conduct your own research and, if appropriate, consult with a licensed financial advisor, broker-dealer, or other qualified financial professional.

Bullseye AI LLC, its owners, employees, and agents are not registered investment advisors, broker-dealers, or financial planners. We are not licensed to provide financial or investment advice.

3. Accounts

3.1 Account Creation

To access certain features of the Service you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] of any unauthorized use of your account.

3.3 One Account Per User

Each user may maintain only one account. Creating multiple accounts to circumvent subscription limits or free trial restrictions is prohibited.

4. Subscriptions and Payment

4.1 Subscription Tiers

Bullseye AI offers multiple subscription tiers including a free tier with limited features and paid tiers with expanded features. Current pricing is available at bullseyeai.org/subscription.

4.2 Free Trial

New users may be eligible for a free trial of a paid subscription tier. Free trial eligibility is limited to one trial per user. We reserve the right to modify or discontinue free trial offers at any time.

4.3 Billing

Paid subscriptions are billed on a recurring monthly or annual basis. By subscribing you authorize us to charge your payment method on a recurring basis until you cancel.

4.4 Cancellation

You may cancel your subscription at any time through the Settings page or by contacting [email protected]. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods except where required by applicable law.

4.5 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days advance notice of any price increase via email. If a payment fails we will notify you by email and may suspend access to paid features until payment is resolved.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Use the Service to engage in market manipulation, insider trading, or any other illegal trading activity
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use automated tools, bots, or scrapers to access or collect data from the Service
• Share your account credentials with others or allow others to access the Service through your account
• Attempt to circumvent subscription limits, rate limits, or access controls
• Use the Service in any way that could damage, disable, overburden, or impair it
• Reproduce, distribute, or create derivative works from the Service's analysis output for commercial purposes without our written permission
• Represent Bullseye AI's analysis as your own original research or as licensed financial advice

6. Intellectual Property

6.1 Our Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Bullseye AI LLC. The Bullseye AI name, logo, and all related marks are trademarks of Bullseye AI LLC.

6.2 Your Content

You retain ownership of any content you submit to the Service. By submitting content you grant us a non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing the Service to you.

6.3 Feedback

If you provide feedback or suggestions about the Service, we may use that feedback without restriction or compensation to you.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted or error-free
• The analysis, signals, or other outputs will be accurate, complete, or reliable
• Any errors in the Service will be corrected
• The Service or its servers are free of viruses or other harmful components

MARKET DATA, ANALYSIS OUTPUTS, AND ALL OTHER INFORMATION PROVIDED THROUGH THE SERVICE MAY CONTAIN ERRORS AND IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. YOU RELY ON SUCH INFORMATION ENTIRELY AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BULLSEYE AI LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Trading or investment losses
• Loss of profits or revenue
• Loss of data
• Loss of goodwill
• Any damages arising from your reliance on the Service's analysis or outputs

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Bullseye AI LLC and its owners, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any trading or investment decisions you make based on information from the Service

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time through the Settings page. Termination of your account does not entitle you to a refund except where required by applicable law.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Bullseye AI LLC is registered, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last updated" date, and sending notice to your registered email address. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
